888 Kitchen Basic Membership: Terms and Conditions

Welcome to the 888 Kitchen Membership Program (the “Program”). The Program is owned and operated by Wai Po Fung Limited (Company No. Insert HK Company Number) (“we,” “us,” “our,” or “888 Kitchen”). By enrolling and participating in the Program, you (“you,” “your,” or “Member”) agree to these Terms and Conditions. Please read them carefully.

1. Program Enrolment & Eligibility

1.1. Eligibility: The Program is open to all individuals aged 18 years or above. While the Basic Membership is free of charge, 888 Kitchen may introduce other membership tiers in the future which may require a purchase.

1.2. Enrolment: To become a Member, you must complete the official sign-up process on the 888 Kitchen Membership web application (the “Membership App”), accessible via the 888 Kitchen website or QR codes provided at our locations.

1.3. Information Required: You agree to provide accurate and current information during the sign-up process, including your name, a valid email address, and a valid mobile phone number.

1.4. Account Security: You are responsible for maintaining the confidentiality of your password and account. You agree to create a secure password and to notify us immediately of any unauthorized use of your account.

1.5. Email Verification: Upon enrolment, a verification link will be sent to your registered email address. This link is valid for six (6) hours. If the link expires, you may request a new one via the “Reset Password” function in the Membership App. Your membership account will not be activated and you will be unable to log in or receive benefits until your email address has been successfully verified.

1.6. Membership Cost & Expiry: The Basic Membership is free of charge and does not have an expiry date.

2. Membership Benefits

2.1. Membership Discount: As a Member, you are entitled to a five percent (5%) discount on the total bill for all regular-priced food and beverage items purchased at participating 888 Kitchen food courts. This discount does not apply to items already under special promotion or any other items as specified by 888 Kitchen management from time to time.

2.2. Sign-Up Bonuses: Upon successful enrolment and email verification, new Members will receive the following one-time bonuses, credited to their Membership App account:

• One (1) digital coupon for a complimentary drink, redeemable only at designated stalls at participating 888 Kitchen locations. This coupon is for one-time use only and is subject to its own validity period as stated in the Membership App.

3. 888 Kitchen Points System

3.1. Earning Points: You will earn one (1) 888 Kitchen Point for every one Hong Kong Dollar (HKD 1.00) spent on eligible purchases at participating 888 Kitchen locations. Points are calculated based on the final transaction value (after any discounts are applied) and can be awarded to two decimal places.

3.2. Point Accrual: Points will be credited to your account upon successful completion of the transaction.

3.3. Non-Transferable: 888 Kitchen Points are strictly non-transferable and cannot be sold, pooled, or assigned to any other person or Member account.

3.4. No Cash Value: Points have no direct cash or monetary value until they are redeemed according to the official redemption rules.

3.5. Point Redemption:

a) Standard Redemption (Cash Discount): The standard redemption option allows Members to convert points into a Cash Discount applicable to their purchases. The initial redemption value is set at twenty (20) points being equivalent to one Hong Kong Dollar (HKD 1.00) Cash Discount. This Cash Discount is applied directly to your bill at the point of purchase.

Redemption Rules for Cash Discount:

• Redemption must be in minimum increments of HKD 1.00 (i.e., in blocks of 20 points).

• A Member must have a minimum balance of 20 points to perform a redemption.

• A maximum of one hundred (100) points, equivalent to a HKD 5.00 Cash Discount, may be redeemed per single transaction.

b) Other Redemption Programs: 888 Kitchen may, from time to time, introduce other special and time-limited redemption programs. These may include, but are not limited to, redeeming points for special discounts on particular products or for other exclusive items.

c) Program Updates & Modifications: All redemption programs, including the point-to-discount exchange rate and redemption rules, are subject to change at the sole discretion of Wai Po Fung Limited. All official and current redemption offers will be published on the 888 Kitchen website. Members will be notified of any significant changes via their registered email address.

4. Member Identification at Point-of-Sale

4.1. Responsibility: To enjoy discounts, earn points, or redeem points for a Cash Discount, you must identify yourself as a Member before making payment at the Point-of-Sale (POS) counter.

4.2. Identification Method: The sole and mandatory method for membership identification is by presenting your unique Membership QR Code. This QR Code is displayed within the official Membership App after you have successfully logged in.

4.3. Failure to Identify: If you are unable to present your Membership QR Code at the time of purchase (for example, due to being unable to log in to the Membership App), benefits (discounts and points) cannot be applied to the transaction, and point redemption cannot be performed. Benefits cannot be retroactively applied after a transaction is completed. It is your responsibility to ensure you have a functioning device with access to your Membership App.

5. Account Management

5.1. Personal Information: You are responsible for keeping your personal information, including your email address and mobile phone number, accurate and up-to-date via the profile section in the Membership App. 888 Kitchen is not responsible for any loss of points or benefits due to outdated or incorrect information.

5.2. Checking Balance: You can check your current points balance and view your transaction history at any time by logging into the Membership App.

6. General Conditions

6.1. Program Modification: Wai Po Fung Limited reserves the right to modify, suspend, or terminate the 888 Kitchen Basic Membership Program, including these Terms and Conditions, its benefits, and its points system, at any time with reasonable notice. Any changes will be posted on the 888 Kitchen website and/or notified to Members via their registered email address. Changes will become effective on the date specified in the notice. Continued participation in the Program after such notice constitutes acceptance of any such changes.

6.2. Privacy and Data Protection:

Compliance with the Personal Data (Privacy) Ordinance (Cap. 486) (“PDPO”):

888 Kitchen Membership Program is committed to complying with the Personal Data (Privacy) Ordinance (Cap. 486) of Hong Kong. By enrolling in and participating in this Program, you consent to the collection, processing, use, and storage of your personal data by Wai Po Fung Limited for purposes related to:

• Program administration and membership management

• Transaction tracking and points calculation

• Service improvements and customer experience enhancement

• Direct marketing communications (subject to your consent and right to opt-out)

Your personal data will be handled in accordance with the six Data Protection Principles under the PDPO and our Privacy Policy.

Your Rights:

Under the PDPO, you have the right to:

• Request access to your personal data held by us

• Request correction of inaccurate personal data

• Be informed of the kinds of personal data held by us

• Opt-out of receiving direct marketing communications

You may exercise these rights by contacting our customer service team via the contact details listed on the 888 Kitchen website. We will respond to your data access request within forty (40) days as required under the PDPO.

Data Security:

We implement appropriate technical and organizational measures to protect your personal data against unauthorized or unlawful processing, accidental loss, destruction, or damage.

6.3. Consumer Protection: This Program is conducted in accordance with the Trade Descriptions Ordinance (Cap. 362) of Hong Kong. We are committed to fair trading practices and will not engage in any false, misleading, or aggressive commercial practices.

6.4. Abuse of Program: Fraud or abuse of the Program, including the pooling of points, misrepresentation, or any dishonest conduct, is strictly prohibited and may result in the termination of your membership and the forfeiture of all accumulated points and benefits without notice or compensation.

6.5. Limitation of Liability: To the extent permitted by Hong Kong law, 888 Kitchen shall not be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with the use of the Membership Program.

6.6. Dispute Resolution: Any disputes arising from these Terms and Conditions shall first be resolved through good faith negotiation. If unresolved, either party may refer the matter to the Consumer Council of Hong Kong for mediation or seek resolution through the appropriate legal channels in Hong Kong.

6.7. Governing Law and Jurisdiction: These Terms and Conditions are governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. You agree to submit to the exclusive jurisdiction of the courts of Hong Kong for the resolution of any disputes.

6.8. Language: These Terms and Conditions are prepared in English. In the event of any inconsistency or different interpretation between the English version and any translation, the English version shall prevail.

6.9. Severability: If any provision of these Terms and Conditions is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be severed and the remaining provisions shall continue in full force and effect.

7. Acknowledgement and Acceptance

By signing up for the 888 Kitchen Basic Membership Program, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. You further acknowledge that you have been informed of your rights under the Personal Data (Privacy) Ordinance and consent to the collection and use of your personal data as described herein.
